Please note you are entering a binding contract and the following terms and conditions together with the information specified in our holiday information section and on the Booking Confirmation Form constitute the basis of your contract. Mediterranean Places arranges bookings of accommodation as agents of the local management company who are suppliers of that accommodation. Your contract for the supply of the accommodation will be with the supplier of the accommodation in question.
Definitions:
In these booking conditions
Mediterranean Places Ltd may be referred to as 'Mediterranean Places', 'we', 'us' and 'our'. The
Client is the 'customer' or 'user' of the property which has been rented by that person. The
Local Management Company is the supplier of the rented property and may be referred to as the 'agent', 'representative' or 'local contact'.
- Issued by Mediterranean Places Ltd on behalf of all property owners and the local property management company promoting and/ or renting accommodation through Mediterranean Places Ltd.
Payment
The Client will pay the total amount referred to in the Agreement/Confirmation Invoice on or before the due date stated on the accommodation Booking Confirmation form /Letting Agreement.
Use of Property
The Client will have the use of the furniture, equipment and contents in the property.
Damage & Breakages
The Client will be responsible for all damage to the Property, the decorations, furniture and other contents except by fair wear and tear. To cover the cost of any property damage or replacement due to breakages you are required to leave a credit card number with the local management company. Failure to do this will result in your being refused entry to the property. It would be appreciated if you would immediately report any damage or breakages caused by you to the local management company to allow them to deal with any problem promptly. On arrival any missing items or damage must be reported to the local property management company within 24hrs.
Property Inspection
The Owners or their Agents may enter the property for the purposes of inspection at any time during the day, upon giving reasonable notice, except in the case of emergency where immediate entry is necessary.
Behaviour
The Client will not do anything in the property which might be a nuisance or annoyance to the owner, or, to the owner or occupier of any neighbouring property. When you book accommodation, you accept responsibility for the proper conduct of all members of your party during your stay. We reserve the right at any time to terminate the stay of any party member(s) whose behaviour is such, in the reasonable opinion of the accommodation provider or us, as to cause or to be likely to cause danger, upset or distress to anyone else or damage to property. Full cancellation charges will then apply and no refund will be given.
Furthermore, we shall be under no obligation whatsoever to pay compensation or meet any costs or expenses you may occur as a result of your stay being terminated.
Occupancy Times
To allow for cleaning and preparation the Client and party cannot enter the Property until after 4.00pm (local time) on the first day of the Period of Letting, unless agreed with the agent and must vacate the Property before 10.00am on the last day of the Period of Letting, leaving the Property, the furniture and contents in the state and position in which they were found on their arrival.
Maid Service
Standard Maid service provided with all properties includes pre-rental cleaning and preparation of the villa or apartment. Complaints about the cleaning should be given in writing to the local property management company within 24hrs of your arrival. After this period they will not accept complaints regarding cleaning. Additional cleaning can be arranged for an additional charge.
Maximum Numbers in Property
During the Letting Period the property will only be used by the client and their party as set out in the Agreement only. The maximum number of persons/beds for each property is shown in the descriptions and must be adhered to (unless by prior arrangement). If additional persons are found above the maximum permitted they will be asked to leave.
Fire & Accidental Damage
If fire or accidental damage renders the property unfit for occupation before the period of letting this Agreement is automatically cancelled and the local management company will endeavour to provide suitable alternative accommodation. If this is not possible the local management company will repay all monies to the Client.
Vacating the Property
After vacating the property and the returning or leaving of the key(s) by the clients, the local management company, following inspection of the property, will destroy the credit card details taken against damage after deducting all sums due (if any) under the terms of this Agreement or as a result of any of its terms being broken.
The Deposit
The deposit against the Rent, and any Balance paid, is not refundable in the event of cancellation by the client except as shown below. Holiday insurance must be taken out at this point and we reserve the right to ask for proof of cover. If you book less than 8 weeks before the arrival date, payment of the total amount is due straight away.
Accidental Injury
The Client is responsible for arranging insurance cover for accidental bodily harm whilst in the property. Except in the case of death or personal injury caused by the negligence of Ourselves, for which Our liability is unlimited, the Owners, Local Management Company or their Agents cannot accept any responsibility for accidental bodily harm to any of the users. Neither party shall be liable for any indirect or consequential losses, including without limit, loss of data, loss of profits, good will or reputation. Holiday insurance must be taken out to cover this aspect.
Final Payment
Mediterranean Places Ltd. or the Local Management Company are entitled to cancel this agreement immediately and without notice if the total rent is not paid by the due date even if it was not formally demanded or if the clients do not comply with the terms of this agreement.
Party Use of Property
Whenever there is more than one user all obligations can be enforced against all the users jointly and against each user individually.
- Mediterranean Places Ltd will act upon any report of malfunction of swimming pool or other item at your holiday accommodation but cannot be held responsible for any malfunction. The local management company must be informed immediately. Clients are expressly asked not to interfere with any swimming pool machinery. We ask that children are supervised at ALL times in the pool and around the property.
Complaints
Complaints received by Mediterranean Places Ltd. after your return to your home country and without our prior knowledge cannot be entertained. It is essential that you contact the local management company immediately if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve difficulties properly unless we or our agent or representative is promptly notified. Discussion of any criticisms with us or our representative whilst you are in residence will usually enable shortcomings to be rectified straightaway. Complaints of a transient nature (for example, regarding preparation or heating of the accommodation) cannot possibly be investigated unless registered whilst you are in residence. If after this you feel that the problem has not been resolved to your satisfaction, then you must within 14 days of returning from your holiday, put your complaint in writing to Mediterranean Places. Send your letter by recorded delivery to the Head Office address. This procedure is designed to ensure the speediest possible investigation and rectification of complaints. Please help us to help you by following this procedure, as otherwise we cannot subsequently consider any complaints nor enter into any correspondence about them and this may affect your rights under this contract.
Optional extras
These are offered independently by the Local Management Company and Mediterranean Places cannot be held liable for any services or goods paid for in Spain.
Pets
Pets are not normally allowed in the properties. However this is not always the case so please check with us as permission may be possible from the local management company who must be informed if a pet is to accompany its owners.
Booking deposit
A non-refundable reservation deposit of 30% of the total (as detailed on the accommodation Booking Confirmation Form/Letting Agreement) is requested at the time of reservation.
Final payment
It is hereby stated that the full rental fee will be due for payment 30 days prior to arrival - the due date is clearly shown on all accommodation Booking Confirmation Form/Letting Agreements issued by Mediterranean Places Ltd. on behalf of the Local Management Company. The balance of the cost of your accommodation is due on the date detailed on your confirmation invoice. If Mediterranean Places do not receive this balance in full and on time, we reserve the right to treat your booking as cancelled by you in which case the cancellation charges set out in clause 27 below will become payable. Payment to be made to Mediterranean Places Ltd as agreed on the returned accommodation Booking Confirmation Form/Letting Agreement. Payments can be made by bank transfer, debit, credit card or cheque. Details are on the accommodation Booking Confirmation Form/Letting Agreement.
Prices
Our prices are based on known costs and projections in November 2007 and we do not expect to have to make any changes. The price of your holiday is, however, subject to surcharges on the following items: government action, currency and fuel costs. Even in this case we will absorb an amount equivalent to 2% of the holiday price which excludes insurance premiums and any amendment charges. If this means paying more than 10% on the holiday price, you will be entitled to cancel your holiday with a full refund of all monies paid except for any money paid to us for amendment charges.
Holiday Insurance
You are required to take out adequate holiday insurance when you book your holiday - Should cancellation of your holiday be necessary your insurance policy should cover all travel and rental expenses (check your policy for terms and conditions) for all members of your party.
Changes to your booking by you
After our confirmation has been issued, any requests for changes must be sent to Mediterranean Places in writing, by email, fax or post, by the person that made the booking. We can't guarantee that we will be able to accommodate your request but we will try to do so. Where we can make the change, an administration fee of £25 will be payable along with any other costs incurred by us in processing the change. However, it is important to realise that we may have to treat requests for changes of accommodation or dates as the cancellation of one reservation and the booking of another. In such cases cancellation charges may be incurred which may be as much as the total cost of your reservation. Mediterranean Places will advise you if this is the case and you must then inform them within 48 hours whether you wish to continue with the original reservation or if you still wish to change your booking. If you advise that you do not wish to continue with your original booking arrangements or if you fail to contact Mediterranean Places within the 48 hours we shall treat your original booking as being cancelled by you. In any event, a minimum charge of 25% of the total villa rental cost will be levied on accommodation or date changes made 10 weeks or more prior to departure. Full cancellation charges will normally apply to changes made within 10 weeks of departure.
Cancellation or Change of your Booking by us
In very rare circumstances, we may have to, and reserve the right to, cancel or alter at any time the whole or part of your booking. We will make every effort to offer comparable alternative arrangements. "Comparable Alternative Arrangements" means a house, apartment or other facilities where the rates charged and provided are approximately the same as those charged and provided for the accommodation or other facilities originally booked and which offer a similar standard. Should we be unable to offer you comparable alternative arrangements, our only obligation is to refund any monies you have paid for the accommodation facilities only (to include the deposit) if the change/cancellation is made prior to departure date, or a pro rata proportion thereof if the change/cancellation is made by us after the start date of the rental. In the unlikely event of a change in the accommodation being necessary after the start of the rental you would be offered alternative accommodation or a refund.
Your Deposit Payment
Your completed form must be accompanied by the deposit mentioned, being part of the total estimated cost of the facilities to be provided. If your booking is extended, a further deposit will be required. However, if you change or cancel part of your holiday it will not be possible to refund the deposit as this will be used to cover the expenses incurred in changing the booking on your behalf. The person who signs the booking form does so on behalf of all persons named therein and binds them to these conditions. We will then reserve your booking and send you a copy of this confirmation. Balance of the invoice will be due 30 days before commencement of the holiday. In the event of a booking made within 8 weeks of the date of departure, the full balance must be paid with the signed booking form.
Cancellation By You
If you have to cancel your reservation you must telephone Mediterranean Places on the number shown on your booking confirmation as soon as the reason for cancellation occurs. You must also confirm your cancellation in writing sent immediately to Mediterranean Places by recorded delivery to the company office address. The day Mediterranean Places receive your telephone notification of cancellation is the date on which your reservation is cancelled. In the event of cancellation you should contact your insurance provider. Whatever the reason for cancellation, a cancellation charge will be payable to Mediterranean Places based on the number of days before the arrival date Mediterranean Places receive your cancellation, as shown in the following table. This means that if you have paid the balance of the cost and then have to cancel, you may receive a refund of part of the cost. However if you have not paid the total cost by the time of your cancellation, you may be required to make a further payment to us. See below for cancellation terms
- More than 45 days before rental period - Deposit (30%) only
- 45 - 30 days before rental period - 50% of full amount
- 30 days or less before rental period - 100% of full amount
Liability
We are under no liability to provide alternative accommodation (comparable or otherwise) or a refund when failure or cancellation of bookings, or dissatisfaction, is due to the acts or omissions of persons over whom we have no control.
Important - Please Note Refunds will not be payable if we are forced to cancel, or in any way change your holiday due to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, or any other reasons outside our control amounting to force majeure. Flight/ Ferry delays are not considered to be alterations by Mediterranean Places. In the event of such delays the carrier may well make alternative arrangements at the point of departure.
Travel
Mediterranean Places are happy to offer advice and guidance to assist with your travel arrangements and hotel stopovers however we do not accept any responsibility for the ultimate arrangements you may choose. Please also note that with all travel bookings the carrier's conditions of carriage apply to the travel element of your holiday and may have clauses which limit or exclude liability. Mediterranean Places can accept no liability for changes to your holiday as a result of changes or delays or cancellation to your travel.
Passports, Visas and Health Requirements
Unless you tell us otherwise, we are entitled to assume that all members of your party are EU citizens who hold or will hold full EU passports valid for the entire duration of the arrangements you chose to purchase. Information on visa, passport and health requirements, where given and applicable, is so given on this basis. All UK residents should carry the new European Health Insurance Card (EHIC). Requirements may change for non EU nationalities and you are therefore strongly recommended to check the up to date position with the supplier of the arrangements, Passport Office, appropriate embassy or consulate or your doctor as applicable in good time before departure.
Data Protection
All information provided to Mediterranean Places Ltd and through us to the Local Management Company will remain confidential and will only be used for the purpose of providing holidays to you.
Enforceability
If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provision of these Conditions and the remainder of the provision in question shall not be affected.
Dispute
In the event of a dispute between the Client and Mediterranean Places Ltd, should we in writing require, the Client agrees to submit to the jurisdiction in accordance with the Arbitration Act 1996 for the time being in force as a legally binding alternative to court action.
Jurisdiction
The contract shall be governed by the laws of England and the Client agrees to submit to the non-exclusive jurisdiction of the English courts.
